To determine eligibility in a number of programs, the California Department of Developmental Services (“DDS”) regularly administers assessments to determine what a person’s developmental disabilities are and how DDS might best serve a person’s needs. In fact, one of the first things DDS does when a person wants to receive benefits is conduct an initial eligibility assessment. The outcome of a person’s assessment has a direct bearing on whether they qualify for services. Because of this, assessments are very important. If you disagree with a DDS assessment that impacts your eligibility for services, you have a right to request an independent assessment. Requesting an Independent Assessment Is Easier Than You Think

Independent assessments can provide additional evidence to support eligibility for DDS services. This can be incredibly important if you are appealing a DDS decision or action. Specifically, a DDS decision that impacts your ability to receive care.

To request an independent assessment, do the following:

  1. Begin by submitting a formal written request for an independent assessment to your regional center. Be sure to explain why you are seeking an independent assessment. Similarly, be sure to state why you think an independent assessment will be better than the one administered by DDS. You can also include your request as part of your Individual Program Plan (“IPP”).
  2. After submitting your request to your regional center, you will likely meet with your care coordinator. In that meeting, discuss key details of your request. This should include factors such as what the assessment will cover and who should administer the assessment.
  3. From there, once your request is approved and you have discussed options with your care coordinator, it’s time to select who you want to administer the assessment. Work with your regional center to make your selection and schedule your assessment.

What Happens If My Request is Denied?

If your regional center denies your request, you may challenge that decision through the appeals process. If needed, you may want to consider contacting a community advocacy group or obtaining legal counsel to handle your appeal.
