When you receive services through the California Department of Developmental Services (“DDS”), you have the right to be informed whenever your services are changed, denied, or reduced. This information is provided in a document called a Notice of Proposed Action. For developmentally disabled individuals and their loved ones, understanding Notice of Proposed Action is critical to ensure you receive the care and support services made availalbe through California DDS.

California DDS Notice of Proposed Action: What it is and Why it Matters

A Notice of Proposed Action is a formal letter from the California DDS that explains a decision that impacts you and your DDS services. Typically, these decisions are made by your regional center or California DDS. A Notice of Proposed Action is intended not only to inform you what the state’s decision is, but ultimately to explain why the state has reached its decision. For this reason, a Notice of Proposed Action must explain the following:

  • What the action being taken is. Examples include reducing hours of support, denying a service, or terminating DDS benefits.
  • What the agency’s reason is for taking the action.
  • The legal basis that support the DDS’s decision.
  • Important information about your right to appeal the decision through a fair hearing.
  • Relevant deadlines for filing an appeal and requesting a fair hearing.
