In California, one of the most important ways people receive care is through the Home and Community-Based Services (“HCBS”) waiver. In essence, the HCBS waiver provides funding specifically for community and home based care. This allows individuals with developmental disabilities to receive the care they need in the communities where they already live, rather than in more institutional settings.
Generally, care provided through an HCBS waiver is delivered by community providers, also known as vendors. Sometimes, individuals or families may decide that a different vendor would better meet their needs. Fortunately, when this happens, there is a process in place that allows you to change vendors. To ensure you and your loved ones get the care you need, it’s important to understand how to switch HCBS vendors mid-year.
5 Steps for Switching HCBS Vendors
Step 1. The first step is to clearly identify what change you are trying to make to your care. Be clear about what you need, why you need, it, and why your current vendor is not meeting these needs.
Step 2. Next, contact your regional center. Let your care coordinator know you want to make a change to your HCBS vendors. Explain why you need to make this change and what you are hoping to accomplish by making the change. Explain why the current vendor may not be the best fit for you. The better you communicate your needs and goals, the better your regional center can help pair you with the best services.
Step 3. From there, your regional care center and services coordinator can help you research alternative vendors. Keep an eye squarely on your needs and goals, and identify vendors that will give you what you need.
Step 4. Once you have identified an alternative vendor, work with your regional care center to update your Individual Program Plan (“IPP”) to reflect the change you’re trying to make.
Step 5. Finally, once you’ve revised your IPP, you can contact your new vendor and begin receiving services from them.
You Have a Right to Switch Vendors
Thanks to the Lanterman Act and other similar laws, you have a right to access individualized care tailored to your unique needs, goals, and life circumstances. A key part of that is the right to select the HCBS vendor that will best serve you. By understanding how to switch HCBS vendors mid-year you can exercise this right and ensure the best possible care for you and your loved ones.
