How to File a DDS Fair Hearing Request

Under California state law, anyone with a developmental disability has a right to receive individualized care and support services. Similarly, if you or your loved one ever receives a decision from the Department of Developmental Services (“DDS”) that you disagree with, or that you think is in error, you also have the right to request a fair hearing. A fair hearing is your chance to explain why you think the decision rendered by California DDS is wrong. Essentially, a hearing is your chance to tell your side of the story. That’s why it’s important to understand how to file a DDS hair hearing request.

What is a DDS Fair Hearing Request and How to File a Fair Hearing Request

To begin with, a fair hearing refers to the process through which an individual formally challenges a state decision or action. Specifically, in the context of the California DDS, a fair hearing is an individual’s chance to challenge a decision or action taken by the DDS. Typically, challenged decisions and actions include a determination of ineligibility, changes to an individual’s benefits, or the state’s decision to terminate DDS benefits. In a fair hearing, the person seeking to challenge the state’s decision appears before an Administrative Law Judge, where they explain why the disagree with the decision they are challenging. The Administrative Law Judge will then decide whether to uphold the state’s decision or require the state to alter its decision in some way.

  4. Submit the Fair Hearing Request Form. Submit your completed request form to the appropriate DDS office.
  5. Wait for Confirmation. After the request form has been submitted, wait until you hear back from the DDS. When the DDS contacts you, they will provide you with all the information you need for your hearing.

Keep in mind that you must file your request for a fair hearing within 30 days of the decision or action you are challenging. Also important is the fact that if you are appealing a decision dealing with loss of benefits you can also request a continuation of benefits until your fair hearing is finished.
